REGISTER OF PUBLIC SECTOR PARTNERS (RPVS)
The Register of Public Sector Partners, or RPVS for short, is a legally established list in which suppliers who receive monetary payment from public entities in Slovakia (Slovak State, respectively, e.g. ministries, then self-governing regions, self-governing municipalities and other entities of state administration and self-government) or assets above the statutory limit.
Persons who enter into a contract, framework agreement or concession agreement in accordance with public procurement regulations, health care providers, persons to whom claims against the state or public sector entities are assigned or otherwise transferred are also entered in the register of public sector partners when the legal limit is met, as well as and subcontractors of such persons. Health insurance companies are also partners of the public sector.
FINANCIAL LIMITS
Financial limits established by law are EUR 100,000 for one-time performance from the contract or EUR 250,000 for partial or recurring performance from the contract. These limits are assessed without VAT and are set for each individual contract. More information is available in the Frequently Asked Questions section.
MANDATORY ENROLLMENT
As a rule, entrepreneurs who want to participate in public contracts as main suppliers or subcontractors, persons applying for a subsidy from public sources or persons purchasing property from public sector entities above the statutory limit are entered into the register of public sector partners (RPVS). In addition to Slovakian entities, the aforementioned obligation also affects many foreign persons who supply goods and services in Slovakia directly, through a subsidiary or an organizational unit.
VOLUNTARY ENROLLMENT
Voluntary registration is also possible, especially in a situation where a public sector entity designates registration in the register of public sector partners as one of the conditions of cooperation. We also encounter voluntary registrations when the registered entity itself wants to achieve better credibility in relation to existing or potential partners in Slovakia.
END USER IDENTIFICATION VERIFICATION BENEFITS
Enrolment in the RPVS is also accompanied by a mandatory verification of the identification of the so-called end users of the benefits, i.e. the real owners of the supplier who directly or indirectly control the company, or who derive certain benefits from participation in the company, e.g. the right to a share in profits, etc.
The end-users of the benefits are registered together with the supplier in the register of public sector partners, with the understanding that their data, including a description of the ownership and management structure, is publicly available within the search engine on the RPVS website.
WHO CAN ENROLL IN RPVS
According to the law, enrolment in the RPVS can only be ensured by a certain group of authorized persons, among whom are lawyers. It is necessary to conclude an Agreement on the fulfilment of the duties of the authorized person for the public sector partner with the authorized person. Subsequently, the authorized person thus contractually secured performs all actions related to the RPVS on behalf of the public sector partner (i.e. not only initial entry, but also subsequent changes or deletion of entered data).
